Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website at https://www.oneasylife.com, the business pages we build, and the Oneasylife directory (together, the “Services”), provided by Oneasylife (“Oneasylife”, “we”, “us” or “our”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who can use the Services

The Services are intended for businesses operating in Australia and for members of the public looking for those businesses. By creating a listing or page, you confirm that you are authorised to act for the business you represent and that you are at least 18 years old.

2. Our Services

Oneasylife builds a simple business web page using information you provide, publishes it, and lists your business in our directory. We aim to make your business easier to find online. We do not guarantee any particular search-engine ranking, level of traffic, number of enquiries or business outcomes, as these depend on factors outside our control (including the policies of third parties such as Google).

3. Your information and content

You are responsible for the accuracy, legality and completeness of the information and content you provide (“Your Content”), including business details, descriptions, pricing, photos, logos, licences and reviews. You must keep it accurate and up to date.

By submitting Your Content, you:

  • grant us a non-exclusive, royalty-free licence to host, use, reproduce, adapt, publish and display it for the purpose of providing the Services (including on your page, in the directory and in search results);
  • confirm you own or have all necessary rights to it and that it does not infringe any third party's rights; and
  • confirm it is not false, misleading or deceptive, and complies with all applicable laws, including the Australian Consumer Law.

You retain ownership of Your Content.

4. Acceptable use

You agree not to:

  • provide false, misleading or deceptive information;
  • post unlawful, defamatory, infringing, offensive or harmful content;
  • impersonate another person or business, or misrepresent your affiliation;
  • interfere with, disrupt or attempt to gain unauthorised access to the Services or their systems; or
  • use the Services for any unlawful or fraudulent purpose.

5. Fees, billing and cancellation

Some Services are paid. Fees and inclusions are set out on our Pricing page and are in Australian dollars. Paid plans are billed in advance on a recurring basis until cancelled. You can cancel at any time, effective at the end of your current billing period; unless required by law, fees already paid are non-refundable.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law that cannot lawfully be excluded.

6. Building and editing your page

We will use reasonable care to build your page from the information you provide. We may make reasonable editorial or formatting changes, and we may decline to publish, or remove, content that we reasonably believe breaches these Terms or any law. We will share a preview for your approval before your page goes live where practical.

7. Third-party services

The Services may rely on or link to third-party services (such as search engines, maps, analytics and payment providers). We are not responsible for third-party services, and your use of them may be subject to their own terms.

8. Intellectual property

The Services, including our software, design, branding and directory (excluding Your Content), are owned by or licensed to Oneasylife and are protected by law. We grant you a limited, non-transferable right to use the Services as intended. You must not copy, modify or create derivative works from our platform without our permission.

9. Disclaimers

To the maximum extent permitted by law, the Services are provided “as is” and we make no warranties beyond those that cannot be excluded by law. We do not warrant that the Services will be uninterrupted, error-free or secure.

10. Limitation of liability

To the maximum extent permitted by law, Oneasylife will not be liable for any indirect, incidental, special or consequential loss, or any loss of profits, revenue, data or goodwill. Where our liability cannot be wholly excluded but can be limited, our liability is limited (at our option) to re-supplying the relevant Services or paying the cost of having them re-supplied. Nothing in these Terms limits liability that cannot be limited under the Australian Consumer Law.

11. Indemnity

You agree to indemnify us against claims, losses and costs arising from Your Content or your breach of these Terms or any law, to the extent caused by you.

12. Suspension and termination

We may suspend or terminate your access to the Services if you breach these Terms, if required by law, or if we discontinue the Services. You may stop using the Services at any time. On termination, we may remove your page and listing.

13. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

14. Governing law

These Terms are governed by the laws of Australia and the State or Territory in which Oneasylife has its principal place of business, and you submit to the non-exclusive jurisdiction of the courts there.

15. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on this page. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
